Some notes regarding copyright of this article.

Probably the easiest way to explain copyright regarding this article, would be to publish part of the reply I received from The State Library of South Australia in response to my request for approval to publish.

".... As some background to the Journal of a Voyage on the Java, the Library purchased the Journal from a descendant of William Richards, a Mr. W. Richards of Kilkenny South Australia in 1966. Unfortunately no legal or donor agreement was entered into at the time, meaning that the Library cannot claim copyright in the item even if that was implied at the time by the purchase. The Library has since had other dealings with Mrs Glenda Richards, also a descendant, however she passed away in 2006, and her children have been difficult to trace. These children are the likely copyright holders.

Under the Copyright Act, unpublished manuscripts remain in copyright indefinitely. However if they are published, the copyright exists only for the next 70 years. The journal was published in a booklet in 1990, so it will be out of copyright in the year 2061.

As such, the current status is "Still in Copyright", and this also applies to the transcript prepared by Library employee Neil Thomas in 1990. The State Library is not the copyright holder, so we cannot give permission to publish. Having made numerous steps to trace copyright holders, we would likely classify the Journal as an orphan work. Under the Copyright Act, we are able to provide copies to customers if it is at least 50 years after the death of the author, and customers require them for research & study or with a view to publication.

You are within your rights to download the images from our website. What you then do with these images/copies of the Journal is at your discretion. "
